The case revolves around a divorced couple, both devastated by the premature death of their only child, yet entangled in a bitter dispute over the final resting place of his ashes.
Liang and Huang’s journey together began in 1985 when they exchanged marital vows. The next year, they welcomed their cherished son, Xiaohuang. Despite the joys of parenthood, their relationship was fraught with disagreements, eventually leading them to part ways in 2015.
Tragedy struck the already fractured family in 2017 when Xiaohuang met an untimely end. Liang, grief-stricken and anguished, believed her ex-husband played a significant role in their son’s mental deterioration and eventual passing. She argued that persistent financial disputes between Huang and Xiaohuang had adversely affected their son’s mental well-being.
To further support her claims, Liang presented phone records, revealing a series of distressing conversations between father and son. She emphasized the grave fact that within a mere span of 25 days post these calls, Xiaohuang was hospitalized five times. Amidst this turbulent period, Liang claimed that Huang remained indifferent, failing to provide their ailing son with adequate care or even notifying her of the dire situation. As a result, Xiaohuang’s final moments were spent in solitude, without the comforting presence of any family member.
Following their son’s death, the ex-couple decided to divide his ashes equally. However, the heartrending saga took another unexpected twist when Liang alleged that Huang had deceitfully taken her share of the ashes. She asserted that he then proceeded to bury their son in Taicang, Jiangsu province, separating Xiaohuang from her family members interred in Shanghai.
Distraught and seeking justice, Liang decided to seek legal redress. She approached the court, demanding the relocation of Xiaohuang’s grave to Shanghai and requested 5,000 yuan (approximately US$680) as compensation for her emotional trauma.
In his defense, Huang refuted Liang’s claims, contending that she had willingly discarded her share of the ashes. He also emphasized that the chosen burial location resonated with Xiaohuang’s wishes.
The courtroom drama culminated with the court denying Liang’s plea due to a lack of concrete evidence. However, the court implored both parents to reconcile their differences and let their son’s soul find eternal peace.
